Boyfriend stop paying second mortgage, and now they are trying to take home what can I do, first mortgage paid

I pay first mortgage on time and taxes on time so how can I keep my home .

The basic right of the second trust deed holder is to acquire the property subject only to the superior rights of the first trust deed holder.

You will have to refinance your 2nd. trust deed or refinance your entire property to pay off the second trust deed hold.

I do not have to tell you how hard it is to obtain a loan. Lately, I see people finding loans from credit unions where this type of lending is allowed.

Keep paying your 1st mortgage timely to attempt to maintain a favorable credit record while you are looking for refinancing options.

Contact the 2nd T.D. holder and see if you can renegotiate your loan, interest rate or foreclosure period.

  2. You need to pay the mortgage if the house (and or mortgage) is in your name. It sounds like this was an agreement between you and the bf, you pay one he pays one, but the banks will not care. If your name is on the house you need to take action now, maybe talk to real estate lawyer or go directly to the bank. Work out a new payment plan and if your bf’s name is on the house make sure you get it off and out the house in your name only since he has proven you can not rely on him
